The recent hue and cry of the opposition over alleged indulgence of the then finance minister and present home minister Mr. P. Chidambram raises a fundamental question, "who has the authority to judge policies". As is clear from the letter involvement of Mr. Chidambram was in policy formation stage i.e. whether or not auctioning should be used as the pricing mechanism for 2G spectrum. The opposition has been alleging that the scam could have been stopped had PC stuck to its stand of auctioning of spectrum.. CAG report gives a no. of calculations to show the loss to public exchequer. The expected loss is a relative question as it was the cheap allocation of spectrum that blessed India with telecom revolution. Do any one believe that 3G revolution will come in India at same speed as 2G as 3G spectrum were auctioned and companies paying high prices will charge high making it in affordable to major section of society. Loss to exchequer is never the prime question facing policy makers has that been the case subsidies would have died out before birth.
It is true that loss did happen to public exchequer however the fundamental question is 'can a policy decision be questioned in court of law and a minister framed for that decision unless it is unconstitutional'. The scam was not of allocating licenses at fixed price rather it was of maliciously befitting some parties by changing the deadlines of offer submission after taking bribe from those parties. The policy doesn't stand to be questioned here and even if a policy is to be questioned the suitable court for this isn't the court of law but the court of public opinion. We must let the public decide if the policies framed by their representatives are to their benefit or not. This is the essence of Democracy which must be maintained at least in country like India that revers democracy. So, PC in my opinion should not be charged in the 2G scam mere for his policy stance unless some new facts come out that throw light on his involvement in malaise implementation of that policy to unduly benefit some.
